Jusqu’au milieu du 20ème siècle le droit de grève est resté contesté aux fonctionnaires, pendant que la loi du 21 mars 1884 l’a reconnu aux salariés du secteur privé. La grève était vue comme dangereuse dans le secteur des services publics ayant comme but la satisfaction de l’intérêt général. Selon Rolland les services publics reposent sur quatre piliers, dont celui de la continuité, qui impose un fonctionnement régulier des services, sans interruptions. En conséquence, la grève qui se définit comme cessation collective et concentrée du travail destinée à appuyer des revendications professionnelles, semble inconciliable avec le principe de la continuité. Il en résultait que le droit de grève était pendant une longue période interdit aux fonctionnaires au nom du principe de continuité. Malgré l’interdiction des syndicats dans les fonctions publiques ils se sont développés dans les fonctions publiques avant leur reconnaissance officielle en 1945. La grève est la conséquence logique du syndicalisme et on ne pouvait pas tolérer les syndicats pendant qu’on interdisait la grève. D’ailleurs, il faut tenir compte du fait que malgré l’interdiction officielle de la grève, certaines très dures se sont développées et ont porté atteinte à la continuité dans les premières années du XXe siècle. Dans ces cas l’aspiration au droit de grève a primé le droit. Il en résulte que l’interdiction totale de la grève risque ainsi d’être dépourvue d’une efficacité totale.
C’est aussi dû à l’extension continue du champ des services publics que l’interdiction totale de la grève ne semble justifiable que dans les cas des services fondamentaux. Finalement, grâce à la disposition relative au droit de grève dans le préambule de 1946, le droit de grève est aussi reconnu dans le service public par le Conseil d’État en 1950 . Le principe de la continuité de l’Etat a été toujours reconnu comme supérieur au droit de grève jusqu’au moment ou le droit de grève est érigé en principe constitutionnel (I) et empiète désormais sur la suprématie apparente de la continuité de l’État ce qui nécessite une conciliation des deux principes (II).
